Notary Services

A Notary Public (also known as a Public Notary) is a practising lawyer authorised by Statute or Commission to perform official functions involving the certification and authentication of documents for international use. Unlike Notaries in civil law countries, in Australia a Notary Public’s work is focused on international documentation. This includes certifying and authenticating documents, and witnessing affidavits, declarations, forms, and other legal instruments for use abroad.

Each country has its own requirements for accepting foreign documents. For some countries, documents must go through a ‘chain of authentication’, where multiple seals are required before they are accepted overseas. This process usually begins with the Notary’s certificate and may then require verification by the Commonwealth Department of Foreign Affairs and Trade (DFAT), followed by legalisation by the relevant High Commission, Embassy, or Consulate.

Many countries, however, are signatories to the Hague Convention (the Apostille Convention), which simplifies this process, while others may accept the seal of an Australian Notary Public without the need for further authentication.
